Succession: Cyprus → Russia
FAQ
Which law governs the estate when the testator lives in Cyprus and the heir lives in Russia?
The testator lives in a participating EU country (Cyprus). Under the default rule of Regulation 650/2012, succession follows habitual-residence law at death; choice of law, exceptions and international treaties require separate checks. Article 22 of Regulation 650/2012 permits a choice in the will of a nationality law (Cyprus), including a non-EU country. This does not guarantee removal of mandatory heir protection: applicable treaties and public-policy exceptions need separate review.
Is there forced heirship?
Cyprus: Forced heirship under the Wills and Succession Law: with a spouse and children up to ¾ of the estate is reserved; only the remainder is freely disposable. A choice of law in the will or a transfer into a structure needs separate review: neither guarantees removal of reserved shares, recovery claims or taxes.
What inheritance taxes apply?
Cyprus: No inheritance tax (abolished in 2000).
How is the estate administered between Cyprus and Russia?
Within the EU there is a single document — the European Certificate of Succession: it is recognised across all EU states except Denmark and Ireland, with no need to go through the procedure in each one. Testator and heir in different countries — documents will need cross-jurisdiction recognition and legalisation (apostille, translation, sometimes a repeat procedure).
