Does a prenup work abroad?
It depends: continental notarial contracts (Germany, France, Spain, Switzerland) travel well, an English court upholds a prenup after Radmacher where it was voluntary and disclosed, and a Russian contract abroad meets questions of form and public policy. For a couple with assets in several countries the answer is mirror agreements plus a legal opinion per jurisdiction.
Can we sign after the wedding?
Yes — a postnup. In Russia and continental Europe it has the same force as a prenup; in England it is historically even sturdier (no eve-of-wedding pressure); some US states scrutinise postnups harder. In Israel an in-marriage agreement needs court approval.
What cannot be written into a marriage contract?
Almost everywhere — children’s matters (custody, residence, contact) and personal non-property relations. England will not let a spouse be left in need, Germany applies the Inhaltskontrolle fairness review, Russia strikes down “extremely unfavourable” terms (Art. 44 Family Code).
Why bother if everything is titled to me?
Community regimes (Russia, France, most of Spain) ignore title: what was acquired during the marriage splits equally whoever it is registered to. And an English court reaches pre-marital assets where needs require. A contract is the only way to replace the default regime with agreed rules in advance.
