A third-country national who is lawfully studying in Spain may, after meeting the requirements, apply from within the country for a residence permit for international teleworkers. These are two independent procedures: student status does not guarantee subsequent authorization, and UGE re-examines remote work, income, qualifications, and social security.

## 1. Student Visa and Stay

**What it provides:** lawful stay for the duration of the approved program. Actual enrollment and compliance with conditions are mandatory: for hybrid higher-education programs, at least 50% of the workload must be in-person. Higher-education students are automatically permitted to work up to 30 hours per week, including self-employment.

**Timelines:** application—at least 2 months before the start of studies; consular decision—up to 1 month \(in practice 2–4 weeks\). For studies longer than 180 days, the visa is issued for up to 365 days, and the TIE card is processed within one month of entry \(don't forget the [entry declaration](https://wiki.private.law/en/spain-entry-declaration)\). An application may also be submitted while legally present in Spain—at least one month before the current status expires.

**Important 2025 change:** under the new regulation [RD 1155/2024](https://www.boe.es/buscar/act.php?id=BOE-A-2024-24099) \(in force from 20.05.2025\), language courses provide grounds for a visa only if they are Spanish or co-official languages of Spain at an official school or center with Instituto Cervantes accreditation. Ordinary English-language courses are no longer sufficient grounds. For subsequent transition, what matters is the lawfulness of work during studies, the nature of the program, and the ability to confirm all UGE requirements.

**Documents:**

- application form, photo, passport valid for at least 1 year;
- proof of enrollment and payment for a course at an accredited center;
- means of support: [100% IPREM per month](https://www.boe.es/buscar/act.php?id=BOE-A-2024-24099) \(in 2025—€600/month; less if accommodation is prepaid\);
- medical insurance from an insurer authorized in Spain \(policy selection—in the [ASISA](https://wiki.private.law/en/asisa-spain-insurance) and DKV reviews\);
- certificate of no criminal record—for stays longer than 180 days \(countries of residence over the past 5 years, apostille and translation\);
- medical certificate.
## 2. Residence Permit for International Teleworkers

**What it provides:** when applying from Spain, the permit may be issued for up to 3 years with the possibility of renewal if conditions are maintained. The applicant must be lawfully present in the country on the date of application; leaving to obtain a new visa is usually not required.

**Timelines:** Ley 14/2013 establishes a special processing period and silencio positivo regime; actual preparation and issuance of the card depend on the completeness of documents and the work of the relevant authorities.

**Requirements:**

- remote work for a company outside Spain \(employment contract or freelance\);
- relationship with the employer for at least 3 months before application; company has been operating for at least 1 year;
- income of [200% SMI](https://www.boe.es/buscar/act.php?id=BOE-A-2025-2576) per month \(in 2025—approximately €2,762, amount indexed annually; supplements for family members\);
- social insurance: A1 certificate or autónomo registration;
- diploma or confirmed 3 years of experience; certificate of no criminal record; insurance.

## Risks and Caveats

The key risk is the lawfulness of remote work during student status. Higher-education students have a special right to work within the established hours, whereas other programs may require separate authorization. Work without the necessary authorization or registration with Seguridad Social may affect the next application.

UGE separately verifies the foreign employer or client, duration of the relationship, income, qualifications, social security, and absence of status violations. The study program should be chosen for educational purposes, not as a formal intermediate shell.

> ⚠️ Student status and residence permit for international teleworkers do not form an automatic "1 + 3 years" program. Each procedure has independent grounds. Before starting remote work, you need to verify the right to work, social-security registration, and compatibility of actual activity with student status.

## Who May Be Eligible for Transition

Transition is possible for a student who is lawfully present in Spain and at the time of application independently meets all requirements of the international teleworker regime: remote work for a foreign company or clients, established duration of relationship, sufficient income, qualifications, and correct social-security status.

Previous visa refusals do not in themselves create either a right to approval or an automatic ban: they are disclosed and assessed together with the grounds for refusal and the new dossier.

## FAQ

### How long in total can one stay in Spain through this route?

The initial student status is valid for the approved period, and the international teleworker permit when applied for from Spain may be valid for up to 3 years and renewable. Counting the study period toward long-term residence and other statuses depends on applicable rules and should not be automatically calculated as a simple sum of periods.

### Will a student visa help if there were previous visa refusals?

A previous refusal does not automatically exclude a new application, but its reason matters. The refusal is disclosed, and the new dossier must remedy previous deficiencies and confirm current grounds.

### Can a student visa be obtained through a language school?

Only through courses in Spanish or co-official languages at a school with Instituto Cervantes accreditation—a requirement of RD 1155/2024. Ordinary English schools are no longer grounds. For transition to residence permit, a higher-education program is more reliable.

### Is it necessary to live permanently in Spain on a student visa?

No, but attendance is mandatory, and for hybrid higher-education programs at least half the workload must be in-person. At the residence-permit stage, presence in the country already matters for renewal.

### Can one work during studies?

Higher-education students—yes, automatically up to 30 hours per week, including self-employment. Language-course students—only with prior authorization.
