Key Employee Initiative \(KEI\) is a single permit procedure for third-country nationals hired by a Maltese company for a managerial or highly qualified position with a base salary not lower than the established threshold. The application is submitted by the employer through the Expatriates Portal.

[Identità](https://identita.gov.mt/expatriates-unit-main-page/noneu-nationals/employment-related-permits/highly-qualified-individuals/key-employee-initiative/) indicates an expected processing time of 5 working days for a complete application. This timeframe does not include preparation, job advertisement, D visa, biometrics, additional requests and card issuance, and does not guarantee approval.

## Who is eligible for the procedure

KEI applies to managers and qualified specialists with a base salary of €45,000 per year or more, as well as to certain employees of innovative startups approved by Malta Enterprise. The position must be genuine, correspond to the candidate's qualifications or confirmed experience, and pass the applicable labour market test.

KEI is not an independent investor residence permit and does not allow formal employment for the sake of status. The employer bears obligations for the application and notification to Identità of termination of employment.

## Procedure

1. The employer publishes the vacancy for at least 2 weeks within the established period before submission.
2. The employer submits the application and complete set of documents through the Identità portal.
3. After Approval in Principle, the applicant obtains a national D visa if necessary.
4. After entry, biometrics, medical and other formalities are completed and the initial card is issued, usually for 1 year.
The total timeframe is not guaranteed in advance: the official 5 working days refers only to the expected processing of a complete online application.

## Requirements and documents

According to the [official checklist](https://identita.gov.mt/expatriates-unit-main-page/noneu-nationals/employment-related-permits/highly-qualified-individuals/key-employee-initiative/):

- employment contract with a Maltese company with a base salary ≥€45,000 and a covering letter from the employer about the necessity of the position;
- employer's declaration of suitability of skills \(Jobsplus Declaration of Suitability\);
- CV on Europass template, signed;
- diplomas, certified and recognized by MQRIC, or—in the absence of relevant qualifications—reference letters about ≥3 years of experience with referees' contacts;
- full copy of passport;
- confirmation of job advertisement \(2 weeks, with publication date\);
- medical screening \(IDCU\) and insurance with coverage ≥€100,000;
- accommodation in the applicant's name: rental/purchase agreement + Housing Authority approval + notarial attestation of rental.
## Resident taxes under KEI

KEI status itself does not automatically make the employee a tax resident of Malta and does not determine their domicile. [MTCA](https://mtca.gov.mt/personal-tax/individual/tax-residence) considers tax residence as a question of facts: in particular, staying over 183 days gives residence for that year, and when arriving with the intention to establish residence, it may arise from the date of arrival. Remittance basis applies to persons who do not have domicile in Malta or are not ordinarily resident: income from Maltese sources is taxed regardless of receipt, foreign income—when received in Malta, and foreign capital gains are not taxed even when remitted. Specific deductions from salary depend on personal tax category and contributions. Comparison with other Maltese tax statuses—in the article about [Global Residence Programme](https://wiki.private.law/en/global-residence-program).

## Family

Under the general [Family Members Policy](https://identita.gov.mt/expatriates-unit-main-page/noneu-nationals/non-employment-permits/family-members-policy/), the application is usually submitted after 12 months of residence. For a KEI sponsor, Identità may consider waiving this period after issuing Approval in Principle; this is an exception, not an automatic right to immediate submission. For consideration, income of at least €50,000 per year for the sponsor and one dependent plus €6,000 for each additional one is required, insurance with coverage from €100,000 for each person and, for children of compulsory school age, an application to a private school in Malta. Identità conducts an individual assessment and may request additional conditions.

## Renewal and trajectory forward

The first card is issued for one year. Upon renewal, a card can be obtained for up to 3 years—this requires a valid employment contract and the original annual tax return stamped by the tax authority. The employer is obliged to notify Identità of termination of employment—the status is tied to work. The long-term trajectory is the usual EU long-term residence mechanisms after 5 years of legal residence.

## Risks and grounds for problems

The employer must confirm the genuineness of the position and the candidate's suitability. Problems arise, in particular, in the absence of MQRIC recognition, salary below the threshold, unverifiable experience, incomplete proof of accommodation or inadequate insurance. A refusal can be appealed to the Immigration Appeals Board.

The status is tied to specific employment. Upon termination of work, the employer notifies Identità, and the applicant requires a new basis or timely change of status.

> 🍓 KEI is a fast-track to the single permit procedure: Identità indicates an expected processing time for a complete application of 5 working days, not a guaranteed decision time or entire route. Early family submission after Approval in Principle may be considered as an exception, but it is not automatic. KEI itself does not determine tax residence; remittance basis depends on actual residence, ordinary residence and domicile. The initial permit is issued for 1 year and can be renewed for up to 3 years. This is not "buying status": the position must be genuine, the salary—paid and declared, and renewal depends on continuing employment.

## Who is it suitable for

The route is suitable for managers and specialists with verifiable qualifications \(diploma or ≥3 years of experience\), ready to work for a Maltese employer with a salary from €45,000; families who are ready to request an exception for early submission after Approval in Principle and take into account Identità's individual decision; those who need an official fast-track to work status in the EU without investment thresholds. It is not suitable for those seeking status without real work, and candidates without verifiable qualifications. ## FAQ

### How quickly can you actually obtain status?

Identità publishes an expected processing time of 5 working days after complete online submission; this is not a guarantee of decision and not the total route timeframe. The total timeframe includes job advertisement, file compilation, visa if necessary, biometrics and possible additional requests, so a fixed end-to-end timeframe cannot be promised.

### What salary is required?

For KEI, a base annual salary of at least €45,000 is required, excluding allowances and bonuses. The €50,000 income relates to requesting an exception for submission before the standard 12 months expire, not to any family reunification: it covers the sponsor and one dependent, plus €6,000 for each additional one; Identità considers the exception individually after Approval in Principle.

### What taxes will I pay?

KEI itself does not establish tax residence or domicile. MTCA determines residence by facts; among the criteria—staying over 183 days or arriving with the intention to establish residence. If a person does not have domicile in Malta or is not ordinarily resident, remittance basis applies: Maltese income is taxed, foreign income—when received in Malta, and foreign capital gains are not taxed even when remitted. Deductions from salary are calculated individually.

### Can I bring my family?

Not automatically. The general rule is 12 months of sponsor's residence; for KEI after Approval in Principle, Identità may consider an exception and allow earlier submission. For consideration, income from €50,000 per year for the sponsor and one dependent \(+€6,000 for each additional one\) is required, insurance with coverage from €100,000 for each person and an application to a private school for children of compulsory school age. The decision is made individually.
